California’s First Standalone ADU Sold for $530,000 as New Laws Reshape What ADU Properties Are Worth

Assembly Bill 976, which took effect January 1, 2025, permanently eliminated the owner-occupancy requirement for standard ADUs statewide. Homeowners are no longer required to live on the property to rent out their accessory dwelling unit, and they may rent both the primary residence and the ADU simultaneously. The law removed a restriction that had previously limited ADU ownership largely to owner-occupants.

Assembly Bill 1033, signed in October 2023, allows local jurisdictions to permit separate ADU sales through condominium conversion. Orange County has not yet adopted the provision, but the San Jose sale at $530,000 for a two-bedroom, 749-square-foot unit demonstrates the financial significance the law carries in jurisdictions that have opted in.

In Orange County, a typical one-bedroom ADU rents for $1,800 to $2,800 per month, with well-located two-bedroom units reaching $3,500 or more, according to recent market estimates. For sellers, a permitted ADU with documented rental income now represents a measurably different asset than it did two years ago.
