What is a Consent Order?

Consentorders are orders made by the Court that formalise an agreement you’ve reached and make it legally binding.  They can be about the division of your property, like your house, your cars and bank accounts.  They might also be about your kids, who they will live with, or if they live with both of you, how often they’ll see each of you.  The consent orders can be about both things at once if you like.  Consent Orders can deal with many things, but the main thing is that you have to have an agreement between the two of you.  You can’t apply for a consent order on your own.  Both parties have to agree on everything in the documents you file, and both parties have to sign off on the papers.

To get Consent Orders Sydney, neither of you is required to use a lawyer or to get advice from a lawyer. The majority of our clients don’t obtain legal advice.  Despite their differences, they can find their way straightforward to reach an agreement with one another that they are each prepared to sign off on. Although this takes work and preparedness to compromise, it is our experience that no one ever regrets going down this pathway.  Sometimes, however, it’s a good idea for each party to get some advice first so that you know your entitlements and go into your agreement with a clear picture.  It is generally a good idea to have a lawyer draft up your consent orders so that you both have peace of mind that the orders are drafted precisely by the agreement you have reached. There are no mistakes, ambiguity, or things that might arise down the track you hadn’t thought of.
